Privacy policy

1. Purpose of this document

The purpose of this document is to describe the data protection and data privacy policy of FinalWire Ltd. (address: 1048 Budapest, Tófalva utca 6. A. ép. III. em. 7., registration number: 01-09-942549, registry authority: Company Registry Court of the Municipal Court of Budapest as Company Registry Court, tax number: HU22764672).

FinalWire Ltd. implements appropriate technical and organisational measures, taking into account the state of science and technology and the costs of implementation, as well as the nature, scope, circumstances and objectives of the processing of personal data , and the risk of alternating probability and severity for natural persons' rights and freedoms, to guarantee a level of data security appropriate to the degree of risk.

FinalWire Ltd., when determining the appropriate level of security, must explicitly take into account the risks arising from data processing, in particular the accidental or unlawful destruction, loss, alteration, unauthorised disclosure or unauthorised access to personal data transmitted, stored or otherwise processed.

2. Data controller

FinalWire Ltd. is considered to be a data controller in the light of the legal relationship with the User and therefore enforces the rules set out in this Privacy Policy in order to ensure the greatest possible data security.

The Data Controller declares that the data is processed in accordance with the laws of Hungary in force at all times, on the basis of the Fundamental Law of Hungary, Act CXII of 2011 on Informational Self-determination and Freedom of Information, and the General Data Protection Regulation (EU) 2016/679 (27 April 2016) of the European Parliament and the Council (“GDPR”).

The www.aida64.co.uk website is run by FinalWire Ltd., the developer of the AIDA64 product family.

3. Scope of processed personal data, method of processing

3.1 Trial versions, software registration

For browsing www.aida64.co.uk and downloading the 30-day trial version of AIDA64 Extreme, no registration is required and we do not record or store any personal information related to our visitors.

Downloading the 30-day trial version of AIDA64 Engineer, AIDA64 Network Audit and AIDA64 Business is subject to registration. To activate the trial versions of these editions, providing the following personal information is required:

  • name
  • company name
  • country
  • e-mail address.

These are stored in order to verify eligibility [Article 6(1)(b) of the GDPR], to send an expiry notice and optionally special offers [Article 6(1)(f) GDPR]]. We do not match the data provided with any additional personal data.

3.2 Purchase

By accepting this Privacy Policy, the User expressly agrees that FinalWire Ltd. process the personal data they provide to the extent necessary to fulfil its contractual obligations as defined in the General Terms and Conditions.

When purchasing AIDA64 products, the User has to provide the following personal information:

For individuals:

  • e-mail address
  • billing address
  • contact name
  • contact e-mail address
  • billing e-mail address.

In case of legal persons:

  • company name
  • e-mail address
  • billing address
  • contact name
  • contact e-mail address
  • billing e-mail address
  • tax number.

We use this information only to ensure that the order is properly executed and that the order details can be consulted with the relevant contact person if necessary [Article 6(1)(b) GDPR], and to issue invoices for the purchase [Art. 6(1)(c) GDPR].

E-mail addresses are requested in order to fulfil our contractual obligations and to send you an order confirmation and license email.

In the case of purchases at a discount, the documents sent to us will be used solely for the purpose of verifying eligibility and will not be disclosed to third parties.

The data required for the invoice are stored in accordance with the provisions of Act CL of 2017 on the Rules of Taxation and are not disclosed to third parties.

3.3 Issuing and re-issuing licenses

When issuing or re-issuing licenses, we identify our customers using

  • the product key issued to them
  • their name (company name)
  • email address
  • billing address

and we do not ask for any other personal information (such as date of birth, mother’s name). In this case, we process data to fulfil the contract (to issue or re-issue the product license) [Article 6(1)(b) GDPR].

3.4 Request for quotation, technical assistance, contact via web form

The following personally identifiable information:

In case of legal persons:

provided on the website by our visitors when requesting a quotation, technical assistance or for any other business is used exclusively for the purpose of which the visitor provided the data [Article 6(1)(a) GDPR]. We do not share Users’ data with third parties.

3.5 Newsletter subscription

FinalWire Ltd. only sends promotional e-mails (newsletters) to the e-mail addresses given in the newsletter subscription form with the express consent of the User, and in the cases and manner required by law [Article 6 (1) (a) GDPR].

The User may unsubscribe from the newsletter at any time, clicking the unsubscribe link at the bottom of the newsletter. We do not share the data of our newsletter subscribers with third parties.

If a visitor decides to subscribe to our newsletter, they may receive information at the email address they provided about the following: product information, product updates, new features on the website, promotions, discounts, competitions.

4. Cookie policy

4.1 What are cookies and what the www.aida64.co.uk website uses them for?

When visiting the website, the user downloads one or more cookies, i.e. a small package of information containing a series of characters, which is used to uniquely identify their browser.

By accepting the information displayed at the bottom of the screen, the visitor consents to the use of FinalWire Ltd.’s cookies described in this policy. During subsequent visits, the message will not be displayed again, but Users will always be able to remove the cookies in the settings of their browser.

Please note that only a limited number of features of www.aida64.co.uk will be available if you disable the cookies. The Help section of browsers provides guidance on how to manage cookie settings.

Necessary cookies

Necessary cookies are essential for the operation of the www.aida64.co.uk webshop, they allow the visitors to put products into their shopping cart and proceed through the payment process. Cookies classified as necessary do not collect information that can be used for advertising products and services and do not record individual settings beyond the duration of the visit.

Statistical cookies

Statistical cookies collect information about how the website is used, such as which pages the user visits. These cookies are completely anonymous and only contribute to improving the functionality of the website and help us understand the interests of users. Cookies classified as statistical do not collect information that can be used for targeted advertising of products and services on third-party websites.

Functional cookies

Functional cookies are used to provide certain services, to store settings and information provided in forms, thus improving the user experience on the website. Cookies classified as functional cannot be used for displaying advertising on third-party websites.

Tracking cookies

Tracking cookies are related to third-party services, such as monitoring the performance of Google and Facebook ads, etc. The third party will provide these services in order to be informed in return about your visit on our website. Tracking cookies can also be used for connecting to social networks (such as Facebook) that may use the information about your visit for displaying personalised ads on other websites.

We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. 5. Data retention

The data processed within the scope of trial versions, software registration, purchase, issuing and re-issuing of licenses will be processed from the date of data submission until the performance of the contract and thereafter to the limitation period of the contractual relationship.

Data relating to invoices issued for purchases will be processed until the accounts are kept for accounting purposes.

The data stored on the basis of consent, such as newsletter subscription, request for quotation, technical assistance and general inquiries, are retained until the inquiry is resolved or the consent is withdrawn.

Logged data is stored by the system for 6 months after the creation of the log, except for the date of last visit, which is always automatically overwritten.

Data protection incident: damage to security resulting in accidental or unlawful destruction, loss, alteration, unauthorised disclosure or unauthorised access to personal data transmitted, stored or otherwise processed. Hereafter referred to as: data protection violation.

FinalWire Ltd. shall notify the relevant supervisory authority of data protection incidents pursuant to the GDPR without undue delay and no later than 72 hours after it has become aware of the incident, unless it is unlikely to pose a risk to the rights and freedoms of natural persons.

6. Users’ rights and enforcement options

The User is entitled to request information about the personal data processed by FinalWire Ltd. at any time and may modify this data at any time. The user is also entitled to request the deletion of their data by contacting us via the channels provided below.

The User is entitled to withdraw their consent to data processing at any time without reasoning, knowing that the withdrawal of consent may jeopardise the fulfilment of the obligations of the Parties under the General Terms and Conditions, but will not affect the legal data processing obligations of FinalWire Ltd.

At the User's request, FinalWire Ltd. will provide information about the personal data it stores of them as well as the purpose, the legal basis and the duration of data processing. Our company will provide the requested information in writing within 30 days of the submission of the request.

The User may also contact FinalWire Ltd. with any questions or comments related to data processing through these channels.

The User may at any time request the correction or deletion of incorrectly recorded personal information without undue delay. In such cases, FinalWire Ltd. will delete personal data relating to the User if one of the following reasons exists:

  • the personal data is no longer needed for the purpose for which they have been collected or otherwise processed;
  • the User withdraws their consent for the data processing and there is no other legal basis for the processing;
  • the User objects to data processing and there are no legitimate reasons for further processing.

The deletion does not apply to data processing required by law (e.g. accounting regulation), such data is retained by FinalWire Ltd. for the period of time required by law.

The User is entitled to receive the personal data relating to them, and provided by them to FinalWire Ltd., in a structured, widely used, machine-readable format and to transfer this data to another data controller.

If the Data Controller fails to comply with any of the above claims of the data subject, the data subject shall contact the National Authority for Data Protection and Freedom of Information (registered address: 1125 Budapest, Szilágyi Erzsébet fasor 22/C, phone number: + 36 (1) 391-1400, fax: + 36 (1) 394-1410, e-mail address: ugyfelszolgalat@naih.hu), and may file a complaint or have the right to apply to the court of the place of decision under the Info Act, the GDPR and the Civil Code (Act V of 2013).

If the User has provided the data of a third party during the registration to use the service or has caused any damage during the use of the website, the Service Provider is entitled to seek damages from the User. In such a cases, the Service Provider shall provide all available assistance to the determining authorities for the purpose of establishing the identity of the infringing person.

7. Other provisions

The aforementioned data will only be used for the purpose of which our User has provided it and will not be shared with third parties (except for the cases listed below), unless required by law.

7.1 With whom do we share your personal information?

Data processing pursuant to this policy: carrying out technical tasks related to data processing, irrespective of the method and means used to carry out these operations and of the place of application, provided that the technical task is carried out on data. Data processor: a natural or legal person, public authority, agency or any other body that processes personal data on behalf of the Data Controller. The newsletter database of the data controller is operated by MailerLite, a service provider.

As a data controller, we may share your personal information with our related businesses and service providers (such as data processors) if this is necessary to provide FinalWire services and support. The term “Related businesses” means companies linked to FinalWire Ltd. through joint ownership or management.

If you contact us, we may share your message and your contact details with our contractual partners.

Your data may also be provided to companies providing services to us or to our clients, such as those that we use for billing or sending emails on our behalf. These entities have limited opportunities to use your information for purposes other than those provided to us.

Data Processors are obliged at all times to comply with our policy on the basis of the service contract concluded with us and to carry out the processing operations according to our instructions. The Data Processors are not authorised to process the data we provide beyond the scope of our instructions.

If required by the law or the protection of our services, we may transfer your personal information to other parties in the following cases:

  • if required by law or by a legal procedure (such as search warrant or other court decision);
  • to verify or ensure compliance with our service regulations;
  • to protect the rights, property and safety of FinalWire Ltd. or any of our related companies, business partners or customers.

In addition to the cases of data sharing described in this Privacy Policy, we may, with your consent or at your request, share any other information related to you with third parties.
